Nodemine (“we”, “us”, “our”) is operated as a personal, non-commercial hobby project by a sole individual based in the United Kingdom. Nodemine is not a registered company, limited liability entity, or incorporated business. By accessing or using our services you accept these Terms in full. If you do not accept them, you must not use our services.
1. Acceptance of Terms
By registering for, accessing, or using any Nodemine service (whether via invitation or otherwise), you confirm that you are at least 13 years of age (or the minimum digital age of consent in your jurisdiction if higher), that you have the legal capacity to enter into a binding agreement, and that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and any policies referenced herein.
We reserve the right to amend these Terms at any time. Continued use of our services following notice of any change constitutes your acceptance of the revised Terms.
2. Nature of the Service & Operator Status
Nodemine is a personal hobby project operated by a private individual in the United Kingdom. It is not a registered business and does not operate as a company. Nothing in these Terms shall be taken to imply that Nodemine is a company, partnership, or other legal entity.
Services currently provided include, but are not limited to, game server hosting, Discord bot hosting, and TeamSpeak 3 (TS3) server hosting. Web server hosting may also be offered from time to time. The platform may operate on an invite-only basis at any time, and we reserve the right to open or restrict access entirely at our discretion without prior notice.
Services are provided on a best-efforts basis by a single individual. Response times and service levels may vary significantly compared with commercial providers.
3. Account and Security
You are solely responsible for maintaining the confidentiality and security of your account credentials. All activity occurring under your account is your responsibility, whether or not carried out by you personally. You must notify us immediately at [email protected] if you become aware of any actual or suspected unauthorised access to your account.
We reserve the right to disable or delete any account at any time without notice, at our sole discretion.
4. Payments and Billing
a. All fees are stated at the point of purchase or in correspondence with you. Prices may be changed at any time with reasonable notice.
b. You must provide accurate and up-to-date billing information. You authorise us to charge the payment method provided for all applicable fees.
c. Failure to make timely payments may result in the immediate suspension or termination of your services without further notice.
d. All payments are processed via third-party payment processors. We are not responsible for errors, delays, or losses caused by those processors.
5. Refunds
a. We will, at our sole discretion, consider refund requests made within 48 hours of the initial purchase of a service, provided that the service has not been materially used and the request is not a consequence of a violation of these Terms.
b. No refunds will be issued after 48 hours, or at any time where service termination results from a breach of these Terms.
c. This does not affect any statutory rights you may have under the UK Consumer Rights Act 2015 or equivalent applicable legislation.
6. Acceptable Use
a. You agree not to use our services for any illegal, abusive, or unauthorised purpose.
b. You will not use our services to host, distribute, store, or transmit any malicious code, malware, ransomware, viruses, phishing materials, or other harmful software.
c. You agree not to conduct or facilitate distributed denial-of-service (DDoS) attacks, port scanning, network intrusion, or any other form of cyberattack using our infrastructure.
d. You will not mine cryptocurrency or carry out any resource-intensive process unrelated to the stated purpose of your hosted service.
e. You will not resell, sublicense, or otherwise transfer access to our services to any third party without our prior written consent.
f. You agree not to engage in any activity that could negatively affect the performance or security of our services or other users’ experiences.
g. We reserve the right to suspend or terminate services immediately and without notice where we reasonably believe a breach of this clause has occurred or is occurring.
7. Content and Intellectual Property
a. You retain ownership of all content you upload or use with our services, including game server configurations, Discord bot scripts, and related files.
b. By using our services, you grant us a limited, non-exclusive, royalty-free licence to host, store, and reproduce your content solely to the extent necessary to provide the services to you. This licence terminates when your account is closed or your content is removed.
c. You warrant that you own or have the necessary rights to use and distribute any content uploaded to or used with our services, and that it does not infringe upon the rights of any third party.
d. We may remove any content at any time without notice if we reasonably believe it violates these Terms or applicable law.
8. Data, Backups and Data Loss
a. You are solely responsible for maintaining your own backups of all data, files, and configurations hosted with us. We do not guarantee the preservation of any data at any time.
b. Data loss may occur due to, but is not limited to: hardware failure, upstream provider outages or closures, software errors, accidental deletion, or other unforeseen circumstances. We shall bear no liability whatsoever for any loss of data, files, or configurations, whether or not a backup service is offered.
c. Where we offer automated backups, these are provided on a best-efforts basis and are not a substitute for your own backup regime. We strongly advise all users to maintain independent copies of their data at all times.
9. Privacy Policy
Your privacy is important to us. Please refer to our separate Privacy Policy for details on how we collect, use, and protect your personal information. We process personal data in accordance with applicable UK data protection legislation, including the UK GDPR and the Data Protection Act 2018.
10. Disclaimer of Warranties
To the fullest extent permitted by applicable law, our services are provided “as is” and “as available” without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation. As a hobby project operated by a single private individual, service interruptions and extended downtime may occur with little or no notice.
11. Limitation of Liability
a. To the fullest extent permitted by law, Nodemine and its operator shall not be liable to you or any third party for any loss of profits, loss of data, indirect, incidental, special, consequential, or punitive damages, or losses arising from service outages or the acts or omissions of third-party infrastructure providers, whether arising in contract, tort, or otherwise.
b. Where liability cannot be excluded by law, our total aggregate liability to you shall not exceed the total fees paid by you to us in the 3 months immediately preceding the event giving rise to the claim, or £50, whichever is the lesser.
c. Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by applicable law.
12. Indemnification
You agree to indemnify and hold harmless the operator of Nodemine from and against any third-party claims, losses, damages, costs, and expenses (including reasonable legal costs) arising out of or in connection with your use of the services, your content, your breach of these Terms, or your violation of any applicable law or the rights of any third party.
13. Termination of Services
We reserve the right to terminate or suspend your services at any time, with or without notice, for any reason including but not limited to violation of these Terms, non-payment, or where continued provision poses a risk to our infrastructure or other users. We will endeavour to provide reasonable advance notice of permanent service discontinuation where practicable, but are under no obligation to do so. Upon termination, we have no obligation to retain or provide copies of your content.
14. Third-Party Services and Force Majeure
Our services depend on third-party infrastructure and service providers over which we have no control. We accept no liability for any loss or damage arising from their acts, omissions, or service discontinuation. We shall not be liable for any failure or delay in performing our obligations resulting from circumstances beyond our reasonable control, including power outages, internet failures, third-party provider closures, hardware failure, cyberattack, or other unforeseen events.
15. General
a. Governing Law. These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute.
b. Severability. If any provision of these Terms is found to be invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force.
c. No Waiver. Our failure to enforce any provision of these Terms at any time shall not be construed as a waiver of that right.
d. Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the services.
